Terms of Service

1. Acceptance of Terms

By accessing or using the PickleHere application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

PickleHere is a hobby project provided free of charge.

2. Description of Service

PickleHere is a community-driven web application that helps pickleball players in Taiwan see live court activity and check in at courts. The Service includes a map of pickleball courts, a list of courts with current player counts, a check-in feature, and a personal playing history.

We may modify, suspend, or discontinue the Service at any time, with or without notice.

3. Eligibility

You must be at least 13 years old (or 16 in the EU) to use the Service. By using the Service, you represent that you meet this requirement.

4. Account Registration

You sign in to the Service using your Google or LINE account. You are responsible for maintaining the security of your authentication credentials and for all activity that occurs under your account.

You agree to provide accurate information and to update it as needed.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any laws.
  • Harass, threaten, or harm other users.
  • Impersonate another person or misrepresent your identity.
  • Submit false check-ins to manipulate court counts.
  • Attempt to gain unauthorized access to other users' accounts or to our systems.
  • Reverse engineer, scrape, or attempt to extract source code from the Service, except as permitted by law.
  • Use the Service to send spam or unsolicited communications.
  • Interfere with the Service's operation or with other users' use of the Service.

We reserve the right to suspend or terminate accounts that violate these rules.

6. User Content

The information you provide (display name, DUPR rating, check-in history, etc.) remains yours. By using the Service, you grant us a limited license to display this information within the Service as necessary to provide it (for example, showing your name in a court's player list when you check in non-anonymously).

You are responsible for the content you submit. Do not submit content that infringes intellectual property rights, contains personal information of others without consent, or violates any law.

7. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services

The Service relies on third-party services (Supabase, Vercel, Google, LINE, OpenFreeMap, and others). These services have their own terms and privacy policies. We are not responsible for the practices of these third parties.

Court information may include data sourced from public databases or community contributions. We do not guarantee the accuracy of court details, hours, or availability.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or free of viruses or other harmful components.
  • Court information, player counts, or other data displayed in the Service is accurate, complete, or up-to-date.
  • The Service will meet your specific requirements.

You use the Service at your own risk. PickleHere is a community-driven hobby project, not a commercial service with operational guarantees.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED USD $10 OR THE EQUIVALENT.

This limitation applies regardless of the basis of the claim, whether contract, tort, statutory, or otherwise.

11. Indemnification

You agree to indemnify and hold harmless PickleHere and its operator from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

You may stop using the Service at any time by deleting your account (contact us as described in the Privacy Policy).

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Upon termination, all rights granted to you under these Terms cease, except for provisions that by their nature survive termination (such as limitations of liability and indemnification).

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Taiwan, without regard to conflict of laws principles. Any disputes arising from these Terms or your use of the Service will be resolved in the courts of Taipei, Taiwan, unless otherwise required by mandatory consumer protection laws.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify users in the Service.
